These terms govern your use of AIS Insights. They apply when you sign up, run a free scan, or subscribe. Please read section 12, which limits what we owe you if something goes wrong.
1. Who you are agreeing with
AIS Insights is the trading name of AIS Insights Limited, a company registered in England and Wales under company number 17513349, whose registered office is at Office 2138, 60 Tottenham Court Road, Fitzrovia, London W1T 2EW.
AIS Insights provides AI search visibility analytics for brands and agencies. “We” and “us” is AIS Insights. “You” is the organisation using the service, and anyone you invite into your workspace. If you are accepting these terms for an organisation, you confirm you have authority to bind it.
Three other documents form part of this agreement: our privacy notice, our data processing addendum, and our cookie policy. Where the addendum and these terms disagree about personal data, the addendum wins.
2. What the service does
AIS Insights runs the prompts you configure against AI assistants, records what they say about the brands you track, and reports on visibility, citations, sources and sentiment over time. Which models you get depends on your plan.
We change the product often, and we may add, change or remove features at any time. If a change materially reduces the core features of a paid plan during a period you have already paid for, we will tell you by email, and you can cancel and get a refund for the unused part of that period. A model we can no longer reach is covered by section 6 instead.
3. Your account
Keep your login credentials secure, and tell us promptly if you think someone else has access. You are responsible for what happens in your workspace, including what the people you invite do in it. Workspace owners can add and remove members, and removing someone ends their access immediately.
You must be 16 or over, and the service is for business use rather than personal use. By signing up you confirm that you are acting for a business, trade or profession, and not as a consumer.
4. Your free scan
Free first scan. No card needed. One per organisation, and we may set limits on it or withdraw it at any time. A free scan comes with no commitment from either of us, and we may delete data from a free scan if the account stays inactive.
5. Plans, payment and cancellation
- Prices are in pounds sterling and exclude VAT and other taxes, which we add where they apply. Enterprise plans are priced separately in a written order.
- Payment is taken by Stripe, in advance, for each monthly or annual period. Your card details go to Stripe and never reach our systems.
- Trials. Where a plan offers a free trial, we take your card details when the trial starts. Your subscription then starts automatically and your card is charged at the end of the trial, unless you cancel before it ends. One trial per organisation.
- Renewal is automatic at the end of each period, at the price then current for your plan. We will give you at least 30 days’ notice by email before any price increase takes effect at your next renewal.
- Cancelling takes effect at the end of the period you have paid for. You keep access until then. Payments are non-refundable, including for any part of a period you do not use, except where these terms say otherwise or the law requires it.
- Late or failed payment. If a payment fails we will try again and email you. We may suspend the service if a payment is still outstanding 7 days after we email you about it.
- Upgrades and downgrades take effect as described at checkout. A downgrade may reduce how many prompts, projects or models you can use.
6. Availability
We work to keep the service available, but we do not promise it will be uninterrupted or error-free, and we do not commit to an uptime figure on self-serve plans. Scans run on a schedule and depend on third-party AI models and data providers, so a scan can be delayed, incomplete or missed when one of them is unavailable or changes how it works.
We collect model answers through third-party data providers, and the models can restrict or block that access at any time. If we can no longer collect a model’s answers, we may replace it with another model or remove it from your plan, and we will tell you by email. This is not grounds for a refund.
We may take the service down for maintenance, and we will try to give you notice of planned work. Enterprise customers can agree a written service level with us.
7. What AI answers are, and are not
This is the part worth reading twice, because it is what the product actually gives you.
AIS Insights reports what an AI assistant said in response to a prompt, at a point in time. AI assistants are probabilistic: ask twice and you can get two different answers, and any one answer may contain statements that are wrong, out of date, or unfair about you, a competitor, or a named person.
So the record we give you is an accurate record of a model’s output. It is not a statement by us that the content is true, and it is not advice. Use it to understand and improve how you appear, and apply your own judgement before acting on it. We are not liable for decisions you take on the strength of what a model said, and we do not promise any particular result, such as better visibility, more citations or a change in what a model says about you.
The same goes for our own analysis. The mentions, citations, sentiment scores, summaries, suggested actions and the in-product assistant are produced by automated analysis and AI models, and they can be wrong or incomplete. Check anything important against the underlying answers before you act on it.
8. Fair use of the service
You agree not to:
- Break the law, or infringe anyone’s rights, using the service.
- Try to gain unauthorised access to the service, other workspaces, or the systems behind them, or test their security without our written permission.
- Resell, white-label or redistribute the service without a written agreement. Agencies using it for client work are welcome and expected, and that is not resale.
- Scrape or bulk-extract the product beyond the export features and the API we provide, or use it to build a competing product.
- Put personal data into the service that you have no lawful basis to process, or deliberately enter special category data.
- Use the service to monitor or profile a private individual. Tracking brands, organisations, products, and people in their public or professional role (a founder, a spokesperson, a public figure) is fine.
- Place a load on the service that degrades it for others, or get round plan limits.
You are responsible for the prompts, brands and other content you put into the service, and for how you use the results, including anything you publish about a competitor or a named person.
We may suspend or close an account that breaks this section, or that puts the service, other customers or us at risk. Where it is safe to, we will tell you first; otherwise we will tell you afterwards.
9. Who owns what
You own your data. Your brand information, prompts, configuration and the results generated for your workspace stay yours. You give us the permission we need to host and process them so we can provide the service.
We own the product. The software, the interface, our methodology and our metrics stay ours. These terms give you the right to use the service, not ownership of it.
Aggregated statistics. We may use aggregated, de-identified information about how the service is used to operate and improve it, and to publish benchmarks. Nothing published this way identifies you, your workspace or the brands you track. We do not use your workspace data to train AI models.
Feedback you give us we can use freely, with no obligation to you.
Other companies’ trademarks. ChatGPT, Claude, Google, Gemini, Microsoft Copilot and Perplexity are trademarks of their owners. We name them to describe the models we track. AIS Insights is not affiliated with or endorsed by any of them.
10. Confidentiality
Each of us may learn things about the other that are not public. We will each keep those confidential, use them only for this agreement, and protect them at least as carefully as our own. This does not apply to anything already public, known before it was shared, or required to be disclosed by law, in which case we will tell you where we are allowed to.
11. Data protection
Our privacy notice explains what we do with personal data as a controller. Our data processing addendum governs the personal data we process on your behalf, and it applies automatically with no signature needed.
12. Our liability
Neither of us limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else the law does not allow to be limited.
Subject to that, our total liability to you under or in connection with this agreement, however it arises, is limited to the fees you paid us in the 12 months before the claim arose. If you have not paid us anything, our liability is limited to £100.
We are not liable for loss of profit, revenue, goodwill, anticipated savings or business opportunity, for loss or corruption of data, for indirect or consequential loss, for the content of AI answers (see section 7), or for the acts of the AI models, data providers and other services outside our control.
The service is provided as it is and as available. As far as the law allows, we exclude every term, condition and warranty these terms do not state, including any implied term about satisfactory quality or fitness for a particular purpose.
Time limit. Any claim against us must be brought within 12 months of when you first knew, or should have known, about them.
Claims by others. You will indemnify us, meaning you cover our losses, costs and reasonable legal fees, against any claim by someone else that arises from the data, prompts or instructions you put into the service, how you use the results, or a breach of section 8. Nothing in this section limits what you owe us in fees or under this indemnity.
13. Ending the agreement
You can cancel at any time, effective as described in section 5. Either of us can end this agreement immediately if the other commits a material breach and does not fix it within 30 days of being told about it, or becomes insolvent.
We can also end this agreement, or stop providing the service, for any reason by giving you at least 30 days’ notice by email. If we do, we will refund any fees you have paid for the period after it ends.
When the agreement ends, your access stops. You can export your data until then. After that we have no obligation to keep it, and we delete your personal data as described in the data processing addendum.
14. Changes to these terms
We may update these terms. For a change that materially affects you, we will email you at least 30 days before it takes effect. If you do not accept it, you can cancel before then, and we will refund any fees you have prepaid for the period after it takes effect. A change we need to make for legal or security reasons can take effect sooner. Continuing to use the service after a change takes effect means you accept it.
15. General
- Governing law. This agreement is governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
- Whole agreement. These terms, the documents named in section 1, and any written order form are the whole agreement between us. You have not relied on any statement, promise or description that is not in them, including anything on our website or in sales material.
- Order of precedence. A signed order form, then the data processing addendum for personal data, then these terms.
- Assignment. You cannot transfer this agreement without our consent. We can transfer it to a company in our group, or to a buyer of all or part of our business.
- Severability. If part of these terms cannot be enforced, the rest still stands.
- No third-party rights. Nobody outside this agreement can enforce it.
- Events outside our control. Neither of us is liable for failing to perform because of something beyond our reasonable control, including an outage, block or change at an AI model, data provider, hosting provider or payment provider.
- Notices. We send notices to the email address of your workspace owner. Send notices to us at hello@aisinsights.com.
